We exist to serve prospective buyers, sellers, renters, and investors throughout the 50 United States by connecting them with licensed real estate professionals. This Privacy Policy explains how we collect, use, disclose, and protect your personal information when you visit our website, submit a referral request, or otherwise interact with our services.

1. Scope & Who We Are
Serving Agent is a real estate referral service. We do not list properties, represent buyers or sellers in transactions, or hold escrow funds. Our role is to introduce consumers in the 50 United States to a licensed real estate agent affiliated with REAL Brokerage Inc. who can serve them in their target market.
This Policy applies to information collected through:
- Our website at the servingagent domain and any subdomains;
- Online forms, including the agent-match request form;
- Phone calls, text messages, and email exchanges with our referral specialist;
- Marketing campaigns, social channels, and other touchpoints we operate.
This Policy does not apply to the privacy practices of REAL Brokerage Inc., individual real estate agents to whom we refer you, multiple listing services (MLS), title companies, lenders, or any other third party. Once we introduce you to an agent, that agent and their brokerage become independent controllers of your information and have their own privacy practices.
2. Information We Collect
We collect personal information that you voluntarily provide and certain information automatically when you use our website.
2.1 Information You Provide
- Identifiers: first and last name, email address, telephone number.
- Geographic information: target city, state, ZIP code area, and current location if shared.
- Real estate intent: whether you are looking to buy, sell, invest, rent, or relocate; timeline; budget range (if shared); property type; military or VA-loan status (if shared).
- Free-text comments: anything you type into the "Anything Else?" or similar message fields.
- Communications content: the contents of emails, texts, and call notes between you and our referral specialist.
2.2 Information Collected Automatically
- Device & usage data: IP address, browser type and version, operating system, referring URL, pages viewed, time on page, and approximate location derived from IP address.
- Cookies and similar technologies: see Section 6.
2.3 Information from Third Parties
We may receive information about you from advertising partners (e.g., a Google or Meta ad you clicked), referral partners, or REAL Brokerage agents who pass back the outcome of a referral so we can confirm the connection was successful.
2.4 Sensitive Personal Information
We do not intentionally collect government IDs, Social Security or Social Insurance Numbers, financial account credentials, precise geolocation, race, religion, health information, sexual orientation, or other sensitive categories. Please do not submit such information through our forms. If you voluntarily disclose sensitive information (for example, in a free-text comment), we will treat it with the same protections as other personal information described in this Policy.
3. How We Use Your Information
We use personal information for the following purposes:
- Provide the referral service: match you with a licensed REAL Brokerage agent in your target market and facilitate the introduction.
- Communicate with you: respond to inquiries, follow up on your request, and provide service-related updates.
- Quality and follow-up: confirm that your matched agent contacted you, gather feedback, and improve our matching process.
- Marketing (with consent where required): send periodic updates, market reports, or relevant offers. You can opt out at any time.
- Analytics and site improvement: understand how visitors use our site so we can improve it.
- Legal and compliance: comply with applicable real estate, tax, anti-spam, and privacy laws; enforce our terms; and protect against fraud or misuse.
4. How We Share Your Information
We share information only as needed to operate our referral service and as described below. We do not sell your personal information for monetary consideration.

Sharing for cross-context behavioral advertising: certain advertising cookies and pixels described in Section 6 may constitute "sharing" under the California CPRA or "targeted advertising" under other state laws. You can opt out as described in Sections 9 and 10.
5. Communications & Consent (TCPA / CAN-SPAM)
5.1 Phone Calls and Text Messages (TCPA)
By providing your phone number on our form, you consent to receive calls and SMS/MMS text messages from Serving Agent and your matched real estate agent regarding your referral request, including by automated dialing systems or pre-recorded messages where applicable. Consent is not a condition of any purchase. Message and data rates may apply. Message frequency varies. Reply STOP to any text to unsubscribe and HELP for help.
5.2 Email (CAN-SPAM)
Marketing emails will identify the sender, include a physical mailing address, and provide a one-click unsubscribe link in accordance with the federal CAN-SPAM Act.
5.3 Withdrawing Consent
You may withdraw consent for marketing communications at any time by clicking "unsubscribe" in any email, replying STOP to any text, or contacting us using the details in Section 14. Withdrawal of marketing consent does not affect transactional messages necessary to complete a referral you have requested.
6. Cookies & Tracking Technologies
We and our service providers use cookies, pixels, and similar technologies to:
- Strictly necessary: deliver the website and remember form input.
- Analytics: understand traffic and usage (e.g., Google Analytics).
- Advertising: measure ad performance and show relevant ads on third-party sites (e.g., Meta Pixel, Google Ads).
You can disable cookies through your browser settings. Disabling cookies may impact site functionality. Many browsers offer a "Do Not Track" signal; we honor recognized opt-out signals such as the Global Privacy Control (GPC) for users in jurisdictions where it carries legal effect (including California).
7. Data Retention
We retain personal information for as long as needed to fulfill the purposes described in this Policy, comply with our legal and tax obligations (including real estate referral recordkeeping requirements that can extend several years), resolve disputes, and enforce our agreements. When information is no longer needed, we delete or de-identify it.
8. Data Security
We use commercially reasonable administrative, technical, and physical safeguards to protect personal information, including encryption in transit, access controls, and vetted service providers. No internet transmission or storage system is 100% secure; we cannot guarantee absolute security. If we become aware of a security incident affecting your personal information, we will notify you and applicable regulators as required by law.
9. California Privacy Rights (CCPA / CPRA)
If you are a California resident, the California Consumer Privacy Act, as amended by the California Privacy Rights Act ("CCPA/CPRA"), gives you the following rights:
- Right to Know / Access: request the categories and specific pieces of personal information we have collected, used, disclosed, and "shared" about you in the prior 12 months (or a longer period if you request it).
- Right to Delete: request that we delete personal information we collected from you, subject to legal exceptions (e.g., recordkeeping obligations).
- Right to Correct: request correction of inaccurate personal information.
- Right to Opt Out of Sale or Sharing: direct us not to "sell" or "share" your personal information for cross-context behavioral advertising. Use the link "Do Not Sell or Share My Personal Information" below or email us. We also honor the Global Privacy Control (GPC).
- Right to Limit Use of Sensitive Personal Information: we do not use or disclose sensitive personal information for purposes beyond those permitted by the CPRA without your consent.
- Right to Non-Discrimination: we will not deny services, charge different prices, or provide a different level of service because you exercised a privacy right.
How to exercise your rights: email privacy@servingagent.com or call the number in Section 14. We will verify your identity (typically by matching information you previously provided) and respond within 45 days, with a 45-day extension if reasonably necessary. You may use an authorized agent; we will require proof of authorization.
Categories of personal information collected, sold, shared, or disclosed in the prior 12 months are described in Sections 2 and 4. We have not sold personal information for monetary consideration. We may "share" online identifiers with advertising partners, which constitutes sharing under the CPRA; you may opt out as described above.
"Shine the Light" (Cal. Civ. Code §1798.83): California residents may request information about disclosures of personal information to third parties for their direct marketing purposes by contacting us. We do not currently make such disclosures.
10. Other U.S. State Privacy Rights
Residents of states with comprehensive privacy laws — including Virginia (VCDPA), Colorado (CPA), Connecticut (CTDPA), Utah (UCPA), Texas (TDPSA), Oregon, Montana, Delaware, New Hampshire, New Jersey, Iowa, Indiana, Tennessee, and others as they take effect — generally have rights to access, correct, delete, obtain a portable copy of their personal data, and opt out of targeted advertising, sale, and certain profiling. To exercise these rights, contact us using the details in Section 14. If we deny your request, you may have a right to appeal; appeals can be submitted by replying to our denial or emailing privacy@servingagent.com with the subject line "Privacy Appeal."
Nevada residents may direct us not to sell certain personal information by emailing the address above. We do not currently sell personal information as defined under Nevada law.
11. Children's Privacy
Our website and services are not directed to children under 16, and we do not knowingly collect personal information from children. If you believe a child has provided us with personal information, please contact us and we will delete it.
12. Third-Party Links and Services
Our site may link to third-party websites, including REAL Brokerage, MLS listings, lender pages, and social media. We are not responsible for the privacy practices of those third parties. Please review their privacy policies before providing personal information.
13. Changes to This Policy
We may update this Privacy Policy from time to time. The "Last Updated" date at the top reflects the most recent revision. Material changes will be communicated by posting a prominent notice on our site and, where required by law, by direct notice to you. Your continued use of our services after changes take effect constitutes your acceptance of the revised Policy.
